JavaVPS respects the intellectual property rights of copyright owners, creators, publishers, developers, businesses, and other rights holders.
This DMCA Policy explains how JavaVPS may respond to credible reports of alleged copyright infringement involving content or activity associated with a JavaVPS service.
Customer Responsibility
Customers are responsible for ensuring that the websites, applications, files, software, media, documents, and other materials they operate or make available through their VPS services are used lawfully.
Copyright Infringement Notice
A copyright owner or an authorized representative may submit a written notice when they believe that copyrighted material is being used without authorization through a JavaVPS service.
To help JavaVPS evaluate a report efficiently, the notice should contain sufficient information to identify the protected work, the allegedly infringing material, and the rights holder making the claim.
Notice Requirements
A copyright notice should contain information substantially sufficient to allow JavaVPS to understand and evaluate the allegation.
Authorization
Identification of the copyright owner or authorized representative submitting the notice.
Protected Work
Identification of the copyrighted work claimed to have been infringed.
Infringing Material
Information sufficient to locate or identify the allegedly infringing material.
Good Faith Statement
A statement that the reported use is not authorized by the rights holder, agent, or applicable law to the best of the complainant's knowledge.
Copyright Complaint Review
After receiving a copyright complaint, JavaVPS may review the submitted information and determine what action is appropriate under the applicable service terms and legal requirements.
Report Received
The submitted information is reviewed for clarity and sufficient identifying details.
Information Evaluated
Relevant service, account, and technical information may be evaluated where appropriate.
Appropriate Action
Depending on the circumstances, JavaVPS may request clarification, restrict access, or take other appropriate action.
Counter Notification
When appropriate under applicable law, a customer may submit a counter notification if they believe that material was removed or access was restricted as a result of a mistake or misidentification.
A counter notification should clearly identify the affected material, explain the basis for the dispute, and contain any declarations or certifications required by applicable law.
Repeat Infringement
JavaVPS may take appropriate action when a customer repeatedly receives credible copyright complaints or repeatedly uses a service in violation of applicable intellectual property requirements.
Review
Report history and relevant service information may be reviewed.
Restriction
Access to affected material or services may be restricted where appropriate.
Service Action
Further service action may be considered under the applicable terms.
Good Faith & Accurate Information
Copyright complaints should be submitted in good faith and should contain information that the complainant reasonably believes to be accurate.
JavaVPS may request clarification when a report does not contain enough information to identify the claimed copyrighted work, the relevant material, or the basis of the complaint.
